In a personal injury case, a property damage claim is separate from any claim that you might have for the injuries that you sustained in a car wreck. This means you can settle and get paid for any damage to your property while we continue treating and working on any injuries.

In a serious motor vehicle accident, it’s possible the damage to your car will render it a total loss. A total loss occurs when your car is damaged enough that repairing the car would cost more than it would to replace it.

What happens when my Vehicle is a Total Loss?

A total loss works similarly to any amount of property damage. A claim adjuster will meet with you to review the damage and determine how much you should be paid. The main difference is that in addition to deciding on a cost of repair, the adjuster must also come up with a value for your car. This will determine whether the car is in fact a total loss, as well as the total amount you will receive.

How much am I Paid for a Total Loss?

Factors that influence your payment for a total loss include the vehicle’s mileage, make, and model. If you have done any work to improve the quality of your car (e.g. if you have just replaced the tires) you may be entitled to extra compensation. Looking up vehicles with similar mileage, make, and model to your own to find your vehicle’s current rates can give you a good estimate of what you may be paid.

Can I keep my Vehicle if it’s a Total Loss?

Typically, if your car is a total loss, the handling insurance company will require that you turn your destroyed vehicle over to the company. You may be able to negotiate keeping the vehicle, but your claim value is likely to be reduced if you do.
